Terms of Service
Terms for WebDock Websites’ custom website buildouts, hosting, support, payments, content, and client services.
Effective date: May 2026
Overview
These Terms of Service explain the basic rules for using WebDock Websites’ website design, website buildout, hosting, maintenance, consultation, payment link setup, SEO setup, and support services.
By purchasing a plan, scheduling a consultation, submitting a payment, approving work, or continuing to use WebDock Websites services, the client agrees to these terms.
If a person purchases services on behalf of a business or organization, that person confirms they have authority to make decisions for that business or organization.
Services
WebDock Websites may provide services such as:
- Custom website design and buildout
- Website hosting or managed hosting
- Domain purchase or connection setup
- DNS setup
- SSL/HTTPS setup
- Website migration or launch support
- Contact form setup
- Payment link or payment portal integration
- Basic SEO setup
- Ongoing website care and content updates
- Consultation and support
The exact scope depends on the selected plan, written proposal, invoice, checkout page, or other written agreement.
Plans and Pricing
Current plans, pricing, onboarding/build fees, monthly fees, and included services are listed on the website or in a written quote.
Plan pricing may change over time. Existing clients will be notified if changes affect their active service.
Fees may include one-time website buildout fees, onboarding fees, monthly hosting fees, monthly care fees, or custom project fees.
Payments
Payments may be handled through a third-party payment provider. Clients are responsible for reviewing the selected plan, price, billing schedule, and included services before submitting payment.
Monthly fees must be paid on schedule to keep services active. If a payment fails, is reversed, or remains unpaid, WebDock Websites may pause work, suspend support, or take the website offline until the account is current.
Clients are responsible for fees charged by banks, credit card providers, or payment processors.
Client Responsibilities
Clients are responsible for providing accurate information, content, approvals, requested access, images, logos, service descriptions, menu details, pricing, legal notices, domain preferences, business names, spelling, and any other materials needed for the website.
Clients are responsible for confirming that they have the right to use all submitted content, including text, photos, videos, logos, trademarks, fonts, and other materials.
Clients are responsible for reviewing website content and domain preferences for accuracy before and after launch.
Website Content
Clients may not use WebDock Websites services for unlawful, deceptive, harmful, abusive, infringing, malicious, or high-risk content.
Prohibited activity includes malware, phishing, scams, copyright infringement, harassment, spam, credential theft, illegal activity, or attempts to disrupt websites, servers, or third-party systems.
WebDock Websites may refuse, suspend, or terminate service if a website creates legal, security, performance, abuse, or reputational risk.
Domains and DNS
WebDock Websites helps with domain setup as part of the website setup and launch process.
If a client already owns a domain, the client keeps ownership and control of that domain. WebDock Websites may request access, instructions, or temporary permissions needed to connect the domain, update DNS records, configure SSL/HTTPS, and launch the website.
If a client does not already own a domain, WebDock Websites may register one standard available domain for the client as part of the website setup service at no additional charge. This domain inclusion is part of the overall setup service and is not a separate cash-value item.
Domain availability is not guaranteed. WebDock Websites is not required to purchase a domain that is unavailable, already registered by someone else, premium-priced, brokered, restricted, unusually expensive, trademark-risk, or otherwise unsuitable. If the requested domain cannot reasonably be registered, WebDock Websites may help identify a reasonable alternative.
No discount, refund, or credit is owed if:
- the client already owns a domain,
- WebDock Websites connects an existing domain instead of purchasing a new one,
- the client’s preferred domain is unavailable,
- the client’s preferred domain is premium-priced or unusually expensive,
- the client chooses not to use a domain purchased or suggested by WebDock Websites,
- a domain cannot be registered because of registrar rules, restrictions, trademark concerns, or other third-party limitations.
Clients are responsible for providing accurate domain preferences, business names, spelling, and approval before a domain is registered. Once a domain is registered, spelling changes, alternate names, additional domains, premium domains, or replacement domains may require additional fees.
WebDock Websites may use third-party registrars, DNS providers, hosting providers, SSL providers, and related tools to register, connect, secure, and manage domains.
For domains registered and managed by WebDock Websites, clients may be provided with access to DNS settings through Cloudflare upon request when reasonably available. Clients who request or use DNS access are responsible for making careful changes and understanding that incorrect DNS changes can affect website, email, SSL, forms, and other domain-connected services.
If client-made DNS changes cause errors, downtime, broken email, broken website behavior, SSL issues, or other technical problems, WebDock Websites may treat the repair work as a maintenance request. If the repair falls outside the routine maintenance included in the client’s active plan, it may require a separate quote or client approval before billable work begins.
Domain Ownership and Transfer
If WebDock Websites registers a standard available domain as part of a client’s website setup, the domain is intended for that client’s business.
If the client later terminates service, WebDock Websites will reasonably assist with transferring the domain to the client or to the client’s chosen registrar, subject to registrar rules, identity verification, account standing, transfer eligibility, timing restrictions, and any unavoidable third-party registrar fees.
WebDock Websites does not charge a separate domain-release fee. However, clients are responsible for any third-party registrar fees, renewal fees, transfer fees, redemption fees, or required registration extensions associated with transferring or keeping the domain active.
Domain transfers may be delayed or restricted by registrar rules, including transfer locks after new registration, recent transfer, or registrant information changes. WebDock Websites does not control registrar transfer rules or third-party processing timelines.
Before a domain can be transferred, the client may be required to verify identity, provide accurate recipient registrar information, create or access a registrar account, pay required third-party fees, and bring any unpaid WebDock Websites account balance current.
WebDock Websites is not responsible for transfer delays, failed transfers, expired domains, DNS downtime, email disruption, registrar lock periods, incorrect recipient information, nonpayment, or third-party registrar actions outside WebDock Websites’ control.
Hosting and Service Limitations
WebDock Websites is designed for small business websites, restaurant websites, local shop websites, service provider websites, landing pages, and similar professional websites.
Unless specifically agreed in writing, WebDock Websites does not provide enterprise hosting, emergency 24/7 support, HIPAA-compliant hosting, financial compliance hosting, custom software infrastructure, high-traffic application hosting, or guaranteed uptime.
No hosting provider can guarantee uninterrupted service at all times. Service may be affected by maintenance, updates, security issues, third-party outages, internet routing problems, client-side errors, or events outside WebDock Websites’ control.
Monthly Maintenance and Website Updates
WebDock Websites’ monthly service plans include routine website maintenance according to the client’s selected plan. Routine maintenance is intended to keep the client’s existing website accurate, functional, secure, and up to date.
A routine maintenance request is a small update to the existing website that does not require new custom functionality, major design changes, third-party integration work, or substantial content creation.
Depending on the plan, routine maintenance may include text edits, image replacements, business information updates, service or pricing updates, link corrections, form adjustments, minor layout changes, mobile or responsive corrections, bug fixes, small content additions, technical updates, SSL/DNS support, hosting-related support, and other ordinary website updates.
The level of included maintenance depends on the client’s active plan. Lower-tier plans are intended for occasional updates and essential corrections. Mid-tier plans are intended for regular updates and minor ongoing improvements. Higher-tier plans are intended for frequent routine updates, priority support, and broader ongoing improvement of the existing website.
A maintenance request is generally included when it updates, corrects, or modestly improves the existing website without materially changing the website’s structure, purpose, design direction, functionality, or technical requirements.
Examples of included maintenance may include:
- updating business hours, phone numbers, addresses, service areas, team members, prices, or menu and service descriptions,
- replacing existing images, videos, logos, or icons supplied by the client,
- editing existing website text,
- adding testimonials, FAQs, small announcements, or portfolio/project entries,
- fixing broken links, buttons, forms, formatting issues, or mobile display issues,
- making minor layout adjustments to existing sections,
- updating metadata, page titles, descriptions, or basic on-page SEO elements where included in the plan,
- monitoring and maintaining hosting, SSL, DNS configuration, uptime, and basic technical functionality where applicable.
Requests that exceed routine maintenance may require a separate quote, plan upgrade, or written approval before work begins. Out-of-scope requests may include, but are not limited to:
- full redesigns, website rebuilds, new website concepts, or brand direction changes,
- large new pages or multiple new sections,
- custom web applications, portals, dashboards, booking systems, calculators, or complex forms,
- e-commerce builds, product catalog restructuring, payment system changes, or inventory systems,
- major copywriting, brand strategy, graphic design, logo design, photography, or videography,
- ongoing SEO campaigns, blog writing, paid advertising, analytics consulting, or marketing strategy unless expressly included,
- third-party platform fees, licenses, subscriptions, plugins, premium assets, or paid integrations,
- emergency work caused by client actions, third-party outages, account lockouts, registrar issues, or unauthorized changes outside WebDock Websites’ control.
WebDock Websites evaluates maintenance requests based on the nature of the request, estimated work required, technical complexity, urgency, frequency of requests, impact on the existing website, and whether the request updates existing functionality or creates new functionality. If WebDock Websites determines that a request exceeds the maintenance included in the client’s plan, WebDock Websites will notify the client and provide available options before performing billable work.
WebDock Websites will not charge additional fees for out-of-scope work without the client’s approval. Included monthly maintenance does not roll over from month to month unless expressly agreed in writing.
Website Changes and Support
Included support depends on the selected plan. Support may include help with hosting, SSL, DNS setup, small content updates, forms, payment links, or launch-related issues.
Support does not automatically include unlimited redesigns, major content rewrites, advanced integrations, advertising management, e-commerce systems, booking systems, client portals, membership systems, database applications, or custom software development unless agreed separately.
Additional work may require a separate quote.
SEO and Search Results
WebDock Websites may provide search-ready structure, metadata, indexing guidance, local SEO setup, or on-page SEO improvements depending on the plan.
WebDock Websites does not guarantee search engine rankings, traffic, leads, sales, or specific placement in Google or any other search engine.
Cancellations
Cancellation requests should be sent to [email protected].
Clients should request cancellation before the next billing date. If a recurring payment has already processed, that payment may not be automatically refunded.
When service is cancelled, WebDock Websites may stop hosting the website, disable support, remove the site from active servers, and discontinue related managed services.
Domain transfer assistance may be available as described in the Domain Ownership and Transfer section. Website export, static file delivery, transfer, or migration assistance is not included unless separately agreed in writing.
Refunds
Website buildout fees, onboarding fees, and setup fees are generally non-refundable once work has started.
Monthly fees are generally non-refundable once the billing period has begun.
WebDock Websites may choose to issue a partial or full refund at its discretion, but doing so does not create an obligation to provide refunds in similar cases.
Backups and Data
WebDock Websites may maintain backups depending on the hosting setup and selected plan, but backups are not guaranteed unless specifically included in writing.
Clients should keep their own copies of important content, images, documents, login information, business information, and website materials.
Managed Website Service and Website Ownership
WebDock Websites provides a managed website service.
Unless otherwise agreed in writing, the client receives the right to use the completed website while subscribed to an active WebDock Websites plan and while the account remains in good standing.
WebDock Websites retains ownership of the underlying design system, codebase, templates, reusable components, development methods, hosting configuration, deployment workflow, and platform infrastructure used to create, host, manage, and maintain the website.
The client retains ownership of client-provided business content, such as logos, original text, photos, menu information, service descriptions, business information, and other materials supplied by the client, provided the client has the legal right to use those materials.
If service ends, WebDock Websites may stop hosting the website, disable access to managed services, remove the website from active servers, and discontinue ongoing support. Website export, transfer, static file delivery, or migration assistance is not included unless separately agreed in writing.
WebDock Websites may offer transition assistance at its discretion or under a separate written agreement. Any transition assistance may be subject to additional fees, technical limitations, third-party platform rules, account standing, and reasonable scheduling availability.
Limitation of Liability
To the fullest extent allowed by law, WebDock Websites is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, reputational harm, or service interruptions.
WebDock Websites’ total liability for claims related to services is limited to the amount paid by the client to WebDock Websites for the affected service during the three months before the issue occurred.
Changes to These Terms
WebDock Websites may update these Terms of Service from time to time. The updated version will be posted on this page with a revised effective date.
Continued use of WebDock Websites services after updates means the client accepts the updated terms.
